By signing a service agreement with Baldwin Home Solutions, LLC, you are signing a legally binding contract agreeing that all specifications, terms and conditions are satisfactory and hereby accept the work to be completed at an agreed-upon price. In the event you break this contract, all deposits made to the company shall be surrendered as damages.
Power Washing uses high pressure and caustic chemicals to clean stains off exterior surfaces. Utilizing this pressure allows the best clean possible, however, operating at such high pressure can also cause damage. Baldwin Home Solutions, LLC’s operator is well trained in utilizing equipment and takes the upmost precautions to make sure the Company does not cause harm to your investment. Although high pressure is not used on residential siding, damage can still occur due to poor maintenance, neglect to the property, and/or low-grade building materials. It is the responsibility of the Client to ensure that their property has been maintained in accordance with its manufacturer’s recommendations and any defects or areas of concern are repaired prior to washing to ensure a watertight surface. The Client assumes all these risks and takes responsibility for any damage that occurs due to the above explanations. On the date of service, the Company will walk around the property and provide the Client with an oral examination of preexisting damage. The examination is not all-encompassing as new damage can become apparent while the surfaces are being cleaned. When damage is found the Company will cease all cleaning efforts until the Client can see the damage and acknowledge its existence. The Client also agrees to release the Company of any or all liability for injuries sustained due to equipment placement to include injuries from tripping, falling, striking equipment, falling debris or equipment.
Client or his/her agent agrees to allow Company on the property for the purposes of cleaning services. The Client understands that there is no set timeframe for the completion of services and several visits to the property may be required. The Company also has permission to visit the property with little to no notice to assess service needs prior to the date of service, as well as to check completion after services have been rendered.
By signing this agreement, you agree to provide Baldwin Home Solutions, LLC the right to use an on-site water supply as needed to complete the stated project without compensation. It is the Client’s responsibility to make sure the water supply is on and in working order before we arrive. If on well water, or if in an area with low pressure or volume, Client agrees to cease all water consumption inside the home to include running of faucets, dishwashers, washing machines, outdoor sprinkler systems, etc.
By signing this agreement, you agree to provide Baldwin Home Solutions, LLC the right to use an on-site source of electricity as needed to complete the stated project without compensation.
While Baldwin Home Solutions, LLC is on location and performing work on your property, you are responsible for keeping all children and pets, as well as other individuals, away from the work area. Children and pets must be kept off the work surface for at least 24 hours after our work is completed. This is for your safety as well as our own.
Scheduling in a business which productivity relies upon the weather can be difficult. Inclement weather may affect scheduling. We try our best to keep scheduling conflicts to a minimum, however, circumstances that are beyond our control may affect your project start and completion dates. You will be notified of any changes.
Removal and replacement of grills, deck furniture, planters and any other items are the responsibility of the homeowner. Should we need to remove items from the deck, we will not be responsible for any damage, breakage or for storage issues. An additional charge may be applied for the time and labor devoted to the removal of these items.
The properties and species of wood age and weather can greatly affect the resulting color or tone of the stain. Note: Variances may occur on individual boards as well as the total project, as densities and other characteristics vary across and throughout the wood. Baldwin Home Solutions, LLC and its operators attempt to represent the final finish color and tones as best as possible. While we can often give you an idea of the overall color or tone, you must expect some variation in the overall finish.
All warranties are limited to those offered by the manufacturers of the products used. Baldwin Home Solutions, LLC offers no additional warranties. If you ever have a concern regarding our work, Baldwin Home Solutions, LLC should be notified immediately.
Some stains cannot be removed by power washing. Tree sap, artillery fungus, splatters from stains and paints are examples of materials that cannot be removed by conventional means. We make every attempt to point these areas out to the Client when quoting the project. Sometimes these stains cannot be removed at all.
The appearance of concrete depends on several factors, most linked to when the concrete was initially poured and cured. When concrete with dirt, mold, mildew, algae and other pollutants and stains is cleaned, the concrete will then reveal any and all imperfections that the pollutants and stains have covered up. The Client understands that not all concrete will look the same even on the same driveway, patio, sidewalk, or concrete slab.
Baldwin Home Solutions, LLC, expects your property to be in good repair and weathertight. This includes but is not limited to all electrical services including receptacles and light fixtures. Doors and windows shall also be weathertight. The Company is not responsible for damages as a result of water infiltration from poor or improper installation, maintenance, or repair of electrical-related items or doors or windows.
Exterior windows may become water spotted as a result of our washing services. Window cleaning is NOT included with pressure washing. Removing or opening any window screens will allow the Company to thoroughly clean exterior windowsills. Removal of the screens will also allow for distribution of detergent and streak-free drying. It is also vital to the preservation of the Client’s property that they notify the Company of any surfaces that cannot be cleaned with high alkaline or acidic detergents.
Baldwin Home Solutions, LLC is not responsible for damages due to improperly installed siding, loose shingles or siding, broken or opened windows, improperly sealed windows and doors, wood rot, defective construction, improperly secured wires, loose or improperly installed gutters, and leaders and improper caulking. In every aluminum siding case and in some cases with vinyl siding, the sun and weather will bleach the color or cause fading. Power washing, which entails the removal of chalky, gritty, or failing surface materials may cause the faded aspects of the vinyl or aluminum to stand out. Baldwin Home Solutions, LLC will not be responsible for such conditions. Baldwin Home Solutions, LLC will not be responsible for loose mortar that may dislodge during the cleaning process.
Baldwin Home Solutions, LLC shall only be obligated under this contract for structural damages which are a direct result of operator error, gross negligence, or willful misconduct. Damages must be discovered and reported within 3 calendar days of said completion. Upon receipt of written notice, the Company shall be allowed 30 calendar days from the date of receipt for the purpose of inspecting the premises. Baldwin Home Solutions, LLC shall have the sole option of repairing or contracting repair work to correct any structural damage that is a direct result of the Company. Baldwin Home Solutions, LLC is not responsible for damage to loose siding, “fogged” windows, damaged paint, or wood trim. Any damage to the above is the responsibility of the homeowner.
Client agrees to allow the Company to utilize any photos, descriptions, reviews, or videos of the property in the context of marketing or advertising for the Company. The Company will use the items described in this section without any compensation to the Client. The Client agrees not to seek punitive action in a civil court of law regarding the development, display, reproduction, or printing of the above examples of media. This does include the use of photos, testimonials and videos posted or displayed in online venues such as social media and/or the Company’s website.
The privacy of the Client is very important to the Company, therefore the Company does not retain the Client’s credit card information on file and will never disclose the Client's physical address. If the Client does not agree to the items described above, please notify the Company before services begin.
Payments to Baldwin Home Solutions, LLC are to be paid by check, cash, or credit card. Should Client utilize credit card for payment, there is a 3% processing fee that will be added to the total. All balances are ALWAYS due upon completion of the job.
Baldwin Home Solutions, LLC reserves the right to attach a mechanics lien against a Client’s property for nonpayment. At 30 days past due a formal notice of intent to file this lien will be sent via registered mail. Baldwin Home Solutions, LLC also reserves the right to enter civil claims court to collect outstanding debt. All legal fees incurred will be added to the remaining unpaid balance. This contract is binding.
